9.1.3

4th line ‘ shall be liable to penalties as prescribed by the authority including cancellation of registration done by it or’ to be deleted



The concerned professional shall report to the Authority about the violation of the building permit by the owner without the revised permit failing which the Authority shall make such recommendation to the statutory / Chartered body governing such profession.



9.1. 3a

The Professional shall also intimate & record with the Authority either by posting a registered letter or by courier or by submission at the Authority’s appointed desk a letter in this regard that the owner has not been utilising the professional service pertaining supervision by the incumbent professional & that no responsibility shall be shared by the professional regarding the undertaking submitted supporting the building permit application which from now onwards be treated null & void.

With immediate effect of such submission by the professional, the building permit shall be suspended by the Authority until the owner appoints & notifies another professional to supervise and clearance from the complaining professional certified regarding the professional fee dues & no extension in respect of the building permit validity shall be allowed.



11.1.4

Also the completion for the residential buildings of plot size 500 sqm in addition to plans approval shall be permitted to be issued by the Architect / Engineer & recorded with the Authority.

12.5    Fees   The Authority may charge a process fee at the rate 3 to 5 rupees per sqm of covered area for the area submitted for approval which shall be the total fee payable by the owner until the occupation certificate is issued by the Authority.

In case of the rejection of the plans, the fee shall be recharged.



There shall be no fee chargeable from the owner for the correction resubmission of the observations any number of times.

After the expiry of one and a half year of the validity of the building permit remaining in force, the work has not been commenced by the owner & the revision is applied to the previous approved plans, 50 % of the amount for the fresh submission shall be charged as revision fee.



No refund shall be made to the owner in case the building is not at all constructed & the permit time lapses.



12.8.1

In case the professional records with the Authority regarding the non-compliance by the owner overruling professionals instructions, the revocation shall be affected if compounding is not acceptable.

‘Any person whose name for the time being is entered in the register of the Council of Architecture constituted under the Architects Act 1972  [Section 2 a & 23]’



A 2.1.1. Competence

The Architect shall perform according to the provisions of the Architects Act 1972 only related to the Buildings designs & construction Profession to the following description of responsibilities-



May enter into a management contract with the building owner under agreed contract terms & conditions of engineering fee structures, all according to the Indian Contracts Act provisions guidance so that the equity based contract is established.





Preparation of all architectural plans & detailed information connected therewith which shall not include structural engineering plans, details & the buildings other supporting services



Preparation of all layouts to be based on Integrated planning with the support of an Engineer/Structural Engineer  & Landscape Architect



Preparation of all services plans  & related information connected with development permit with the support of the Electro Mechanical & Information Technology engineers





Issuing certificate of Supervision & Completion of all buildings pertaining to architectural controls items & all items with the supporting engineer/structural engineer

A-2-2

Engineer

Since engineer has to take instant decisions in the project designs & during the construction of buildings factually involving complex process of engineering operations in theory, designs & practice, which it is not expected of a fresh graduate or a post graduate  be in a position to handle independently without undergoing/possessing tutorial experience under the control of a qualified & experienced engineer in the field of design or execution.



An Engineer shall have a minimum accredited Indian or foreign engineering degree BE/B Tech/Section A & B of The Institution of Engineers [ India ] in Civil Engineering branch.

In addition to above, the engineer shall be a Corporate Member of The Institution of Engineers [India] attached to the Civil engineering division and authorised to use the style & title Chartered Engineer [India] minimum AMIE

[BE+(5-10 years)/ ME+(3-8years)/ Phd+(2-7) years].



Competence

By virtues of the IEI royal charter of incorporation 1935 the Corporate Members Chartered Engineers [India] draw the following powers to be utilised in the professional pursuit.



2        The object and purposes for which the Institution of Engineers (India) (hereinafter called “the Institution “) is hereby constituted are to promote the general advancement of Engineering and Engineering science and their application in India and to facilitate the exchange of information and ideas on those subjects amongst the Members of and persons attached to the Institution and otherwise, and for that purpose-

a       To promote and advance the science, practice and business of Engineering in all its branches (hereinafter referred to as “ Engineering “ in India.



f      To encourage, regulate and elevate the technical and general knowledge of persons engaged in or about to engage in Engineering or in any employment manual or otherwise in connection therewith and with a view thereto provide for the holding of classes and to test by examination or otherwise the competence of such persons and to institute and establish professorship, studentships, scholarships, rewards and other benefactions and to grant Certificates of Competency whether under any Act of the Government of India or Local Governments regarding the Conduct and Qualifications of Engineers or otherwise



4        Every person being at any time a Corporate Member of the Institution may so long as he shall be a Corporate Member take or use the name or title of “Chartered Engineer (India)’



5        And We do hereby, for Us, Our Heirs and Successors Grant and declare that these Our Letters Patent, or the enrolment or exemplification thereof, shall be in all things good, firm, valid and effectual, according to the true intent and meaning of the same, and shall be taken, construed and adjudged in all Our Courts or elsewhere in the most favourable and beneficial sense and for the best advantage of the said Institution, any mis-recital, non- recital, omission, defect, imperfection, matter or thing whatsoever notwithstanding



In Witness whereof We have caused these Our Letters to be made Patent

Competence for Engineer



To enter into a management contract with the building owner under agreed contract terms & conditions of engineering fee structure, all according to the Indian Contracts Act provisions guidance so that the equity based contract is established.



Preparation of all plans & connected detailed information therewith in relation to the building permit particularly for all the (formation mechanism) framed structural buildings such as RCC/ /Structural Steel/ buildings & all structures up to 8 floors/stories or 30 m height

[To design all buildings & document the design drawings & calculations using the authorised style & title Chartered Engineer (India) subscribed with corporate membership reference & this seal shall be used wherever legally necessary.]



Engineer shall maintain soft copy records for all designs & produce for presentation if so required by the owner or the Authority



Preparation of all services plans  & related information connected with development permit with the support of the Electro Mechanical & Information Technology Engineers.



To supervise all buildings in all respects of building engineering including services & its coordination  & Issuing Certificates of Supervision  & Completion for all types of buildings & as well as Structural Stability/ Structural Safety Certificates for the Completion & the building Occupation Certificate release by the Authority.


To estimate & evaluate the quantities of the works carried out  & payment certification   issue for the contractor



To do all quality assurance works & documentation with the assistance of a quality assurance engineer



Preparation of all layouts to be based on Integrated planning with the support of an Architect & Landscape Architect



To prepare & submit all layouts for zoning & set backs decisions if so required



To administer all the contractual obligations including drawing contracts & all other duties conducive to achieve objectives of project management



Issuing certificates of supervision for development of land for all areas



To be personally responsible & liable for all performed professional acts





A-2-.3 Structural Engineer



A Structural Engineer shall be having a minimum accredited Indian or foreign engineering degree BE/B Tech/Sec A & B of The Institution of Engineers[ India ] in civil engineering branch.

In addition to above the engineer shall be a corporate member of The Institution of Engineers India attached to the civil engineering division and authorised to use the style & title Chartered Engineer India MIE

[BE+(10-15) years/ ME+(8-13) years/ Phd+(7-12) years].



Competence

In addition to enjoying all the competencies as an Engineer as given above, a Structural Engineer shall have all the powers to work on the designs & calculations for all the structures of all buildings of any sort & architecture or elevation or special features/ facia. Structural Engineer shall maintain soft copy records for all designs & produce for presentation if so required by the owner or the Authority





A-2.4   Supervisor  



The minimum qualification of a supervisor shall be as follows



An accredited engineering degree in civil engineering & registered as AIE with IEI



Three years accredited civil or architecture diploma with 5 years experience in the building engineering field under the supervision of an Engineer or Architect or structural Engineer & registered as senior technician with IEI or licensed by the Authority

A-2.6 Project Management Engineer



To improve the buildings design & constructions execution controls which have been adversely effected in India due to bad workmanship & designs in the past many years & due to engineering development in the building engineering disciplines, many advanced technologies have come up to replace the obsolete know how, engineers of generally all disciplines shall be contributing in the design as well as in the field offices to the achievement of quality buildings production objective. There has arisen needs nationally as well internationally that these members of the team have to be controlled by a general command so that proper coordination is maintained all times to run smoothly process of designs & construction.



To meet such a demand some very senior engineering personnel experienced in the buildings field is a necessity & hence Management Engineer to share the responsibility of an overall Project Engineer is entitled.



Also the WTO regime requires international mobility effective 2004/2005 & the standards have to be met globally.



In the year 2003, Engineers Mobility Forum an international body to regulate the Professional Engineers according to the provisions under WTO regime has granted provisional membership # 13 to the Institution of Engineers [India] to represent India on its forum. The engineers so registered shall be free to practise anywhere on the globe without any further verification of individual engineering credentials.



Qualifications

A Management Engineer shall be qualified as one of the followings



A         A very senior professional expert registered with the IEI as Professional Engineer [India] attached with Civil or Architectural engineering division or



B         An architect with an experience not less than 15 years in the buildings & senior member of the Institution of Architects India since there is no provision in the Architects Act 1972 for Senior Architect registration  & shall be supported by an Engineer for the structural matters Or



C         A Professional Engineer experience in the buildings engineering discipline registered with Engineers Mobility Forum effective 2004/2005



Competencies



To enter into a management contract with the building owner under agreed contract terms & conditions of engineering fee structure, all according to the Indian Contracts Act provisions guidance so that the equity based contract is established.



Management Engineer shall be an overall in charge of all the operations of a major project including all the competencies of an Architect & an Engineer / Structural Engineer where one Architect or Engineer /Professional is inadequate & shall be directly accountable to the promoter or the owner & the Authority.



Overall responsibility of works adequacy & correctness, budget control & cost planning, quality assurance, time management & control, health & safety, environment control, coordination, site management control, contractor’s performance controls & all possible unlimited responsibilities with full professional obligations to bring the project to a successful completion.



A 2.7



Construction Project Site Agent/ Construction manager

Qualification

Preferably a Professional Engineer/ Chartered Engineer MIE/ Architect with minimum 15 years experience depending on the project size & magnitude



Competence

To control the construction execution of all site operations directly reporting to the Resident Engineer or Engineer/Management Engineer as the case may be

Fully responsible for anything that happens on site

Fully responsible for all the site as well as day to day coordination

Fully responsible for the site activities control & keep the progress in line with the programme

Project Coordinator/ Project Office Engineer to be provided to assist the Agent

Quality Assurance Engineer to be provided to assist on a considerable size project to assist the agent



Project Coordinator/ Project Office Engineer



Preferable a Registered professional Engineer or A chartered Engineer must.

Very responsible position to carry out the production of technical documents such as Construction Method statements, designs on site, detailing on site, Site Technical Queries, Working drawings, shop drawings, coordination, correspondence, coordination among site engineers as well as with the Management, material requisition, bar bending schedule for fabrication, attending the quality & the progress meetings etc



Quality Assurance Engineer



Preferable a Registered professional Engineer or A Chartered Engineer must.

Very responsible position to effect the production of Inspection & Testing Plans, Inspection Check Lists & site inspections for the release of the holds & coordination with the Project Office Engineer & the Site Engineers as well as with the Management Quality Manager or engineer as the case may be. Responsible for the laboratory coordination & monitoring quality policy of the contractor

Site Engineer

Minimum BE or equivalent in relevant engineering discipline for a major project more than 4 storey with sufficient experience on buildings as required by the management



A 3 years civil engineering diploma for minor projects involving no major structures/ frames with sufficient experience on buildings as required by the management



A 3 years architectural diploma for minor projects involving no major structures/ frames with sufficient experience on buildings as required by the management.
